1. Who we are, and what this covers

MGKFitness: Run ("the app") is provided by MGKCodes Ltd, a company registered in England and Wales. These terms are the agreement between you and us for your use of the app.

By installing or using the app you accept them. If you do not, do not use it.

Your privacy is covered separately by our Privacy Policy, which forms part of these terms.

2. What the app does

The app records your runs, keeps a training log on your device, and — if you subscribe — provides an AI coach that builds and adjusts a training plan and answers questions about your training.

Recording and reviewing your own runs is free and always will be. What a subscription buys is the coach's reading of them.

3. This is not medical advice

Read this one properly.

The app prescribes physical exercise. It is a fitness product, not a medical device, and nothing it produces is medical advice, diagnosis or treatment. The plans, paces, distances and observations it generates are produced automatically from the data you give it, and no clinician has reviewed them.

You are responsible for deciding whether any session is safe for you on the day.

Talk to a doctor before starting or changing a training plan if any of the following apply: you have a heart condition, chest pain, dizziness or fainting; high blood pressure; a bone, joint or muscle problem that exercise could worsen; you are pregnant or recently gave birth; you are recovering from illness, surgery or injury; you take medication that affects your heart rate or blood pressure; or you are over 40 and have not exercised regularly.

Stop and seek medical attention if you feel unwell while exercising — chest pain, severe breathlessness, dizziness, or pain that is sharp rather than muscular.

The app cannot see you. It does not know how you slept, what else you did today, or that something hurts unless you tell it. Your judgement overrides the plan, always.

4. Your account

You can use the app without an account. If you create one, you must give an accurate email address, keep your login secure, and tell us at run@mgkfitness.mgkcodes.com if you believe someone else has used it.

You must be at least 16 to create an account.

One person per account. Do not share your login.

5. Subscriptions, billing and cancellation

The coach is sold as an auto-renewing subscription, in tiers described in the app at the point of purchase.

• The price you pay is the one your store shows you in your own currency at the time of purchase. Prices may change; a change never applies to a period you have already paid for, and your store will tell you before a renewal at a new price.
• Payment is taken by the store, not by us — Apple for App Store purchases, Google for Google Play. We never see your card details.
• It renews automatically at the end of each period unless you cancel at least 24 hours before the period ends.
• Cancel through your store, not through us: App Store subscriptions in Settings on your device, Play subscriptions in the Google Play app. We cannot cancel a subscription for you, because we are not the party taking the money.
• Cancelling stops the next renewal. It does not end the period you have paid for, and you keep the coach until that period runs out.

Refunds are the store's decision, not ours. Apple and Google each operate their own refund process and their own rules, and we have no ability to issue, refuse or expedite one. If you believe you are owed a refund, ask them. If something we did caused the problem, email run@mgkfitness.mgkcodes.com and we will help you make the case, but the decision is not ours to make.

If a subscription lapses, your runs, plans and history remain on your device and in your account. Nothing is deleted because you stopped paying — you lose the coach, not your training.

6. Fair use

The coach costs us money for every question it answers, so subscriptions carry usage limits, applied per tier and described in the app. They are set well above what a runner training seriously would use.

Do not attempt to resell access, automate requests, or use the coach for anything other than your own training.

7. What you may not do

• Use the app for any unlawful purpose.
• Attempt to gain access to another person's account or data.
• Reverse engineer, decompile or interfere with the app's security, except where the law expressly permits it, or where the app's own licence allows it — the source is published under the AGPL, and that licence grants rights these terms do not remove.
• Upload content you have no right to share, or use the coach conversation to submit another person's health information.

8. Your content, and who owns what

Your runs, your plans and your conversations are yours. We claim no ownership of them. You grant us only the permission we need to run the service: to store your data where you have asked us to, and to send the training context described in the Privacy Policy to our AI provider so the coach can answer you.

The app itself, its name and its design remain ours.

9. Availability, and what we are responsible for

The app records without a network and without us. Recording, your log and your history work whether or not our servers are up, which is deliberate and is the most important thing in this section.

The coach needs a connection and our servers, and those can be unavailable. We do not guarantee uninterrupted service, and we may change or withdraw features. If we withdraw the coach entirely while you are subscribed, we will stop billing and tell you.

GPS is approximate. Distance, pace and route come from your phone's positioning hardware and are not measurement-grade. Do not rely on them where accuracy matters materially.

We are responsible for loss caused by our breaking these terms or failing to use reasonable care, where that loss is a foreseeable result. We are not responsible for loss that is not foreseeable, for business losses, or for your data where you have chosen not to back it up — with backup off, your phone holds the only copy and an uninstall or a lost phone loses it, which the app tells you plainly before you make that choice.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. If you are a consumer, you keep every right the law gives you and nothing here takes those away.

10. Ending this agreement

You can stop using the app at any time, delete your account in Settings, and uninstall it.

We may suspend or end your access if you materially break these terms. If we do, and you have paid for a period you cannot now use, we will ask your store to refund the unused part.

11. Changes to these terms

We will update these terms as the product changes, and the date at the top will say when. If a change materially reduces what you get, we will tell you in the app before it takes effect. Continuing to use the app after that is acceptance; if you would rather not accept, cancel and stop using it.

12. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere in the UK, you may bring proceedings in your own jurisdiction.

If you are a consumer in the EU or the UK, this does not deprive you of the protection of the mandatory consumer law of the country you live in.
